DOL Rule Governing Labor Certification Substitution and Labor Certification Validity Dates
On Friday, April 27, 2007 the Office of Management and Budget (OMD) completed its review of the U.S. Department of Labor's proposed regulation which among other things seeks to bar substitution of employees in labor certification applications and to limit the validity of a labor certification application to 45 days. The regulation is now in the final stages of review. The DOL has not published a final regulation and an effective date, however, final publication may take place in the near future.
